Terms of Service

1. Acceptance of Terms
By accessing or using Atlas CRM (the “Service”), operated by Atlas Digital Co. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to “you” will mean that organization.
These Terms constitute a legally binding agreement between you and Atlas Digital Co.. We may update these Terms from time to time, and continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
2. Description of Service
Atlas CRM is a cloud-based customer relationship management (CRM) platform that provides tools for managing contacts, deals, pipelines, communications, automations, and analytics for sales and revenue teams.
The Service includes, but is not limited to:
- Contact and company management
- Deal pipeline and forecasting tools
- Email integration and sequencing
- Workflow and automation builder
- AI-assisted features (deal prediction, lead scoring, email drafting)
- Reporting and analytics dashboards
- Third-party integrations (Gmail, Slack, Zoom, and others)
- API access (subject to plan)
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. User Accounts and Registration
To use the Service, you must register for an account. When registering, you agree to:
- Provide accurate, complete, and current information
- Maintain the security and confidentiality of your account credentials
- Immediately notify us of any unauthorized use of your account
- Not share your account credentials with others outside your authorized team
You are responsible for all activity that occurs under your account. Atlas Digital Co. is not liable for any loss arising from unauthorized use of your account where you have failed to maintain credential security.
You must be at least 18 years old to create an account. Accounts created for organizations must be created by an authorized representative of that organization.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
4. Subscription and Billing
Atlas CRM is offered on a subscription basis. By subscribing, you agree to pay the applicable fees as described on our pricing page.
Billing Cycles: Subscriptions are billed monthly or annually, depending on the plan selected. Annual plans are billed in full at the start of each billing period.
Free Trial: We may offer a free trial period. No credit card is required for free tier plans; a valid payment method is required when upgrading to a paid plan. Trials automatically convert to paid subscriptions unless cancelled before the trial ends.
Payment: We use Stripe to process payments. By providing payment information, you authorize us to charge your payment method for all fees due. All fees are in USD unless otherwise stated.
Price Changes:We may change subscription prices with at least 30 days' advance notice. Price changes take effect at the start of the next billing period after the notice period.
Refunds: Fees are non-refundable except where required by applicable law or at our sole discretion. Unused time on monthly subscriptions is not refunded upon cancellation.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access until that date.
Overdue Payments: We may suspend or terminate your access to the Service if payment is not received within 15 days of the due date.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to send unsolicited commercial messages (spam) in violation of applicable law
- Upload or transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate any person or entity or falsely state your affiliation with any person or entity
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means (bots, scrapers, crawlers) to access the Service in ways that exceed normal usage patterns
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to store or transmit malicious code, viruses, or other harmful software
- Violate any applicable local, national, or international law or regulation
- Use the Service in any way that could harm Atlas Digital Co., its customers, or the public
We reserve the right to investigate and take appropriate action against violations, including suspending or terminating accounts and reporting to law enforcement authorities.
6. Intellectual Property
Our IP: The Service, including its design, features, content, software, trademarks, and branding, is owned by Atlas Digital Co. and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
Your Data:You retain full ownership of all data, content, and information you submit to the Service (“Customer Data”). By submitting Customer Data, you grant Atlas Digital Co. a limited, non-exclusive, royalty-free license to use, store, and process your Customer Data solely to provide the Service to you.
Feedback: If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without any obligation to you.
API: If we provide API access as part of your plan, we grant you a limited, revocable, non-exclusive, non-transferable license to use the API solely to build integrations with the Service for your own internal business purposes.
7. Data Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information and is incorporated into these Terms by reference.
By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining any necessary consents from individuals whose data you enter into the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATLAS DIGITAL CO. AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
9. Termination
By You: You may terminate your account at any time by cancelling your subscription through the account settings or by contacting us. Upon termination, your right to use the Service ceases immediately at the end of your current billing period.
By Us: We may suspend or terminate your access to the Service immediately, without prior notice, if:
- You breach any provision of these Terms
- We are required to do so by law
- We reasonably believe your account is being used fraudulently or to harm others
- You fail to pay applicable fees after a reasonable cure period
Effect of Termination: Upon termination, your license to use the Service ends. We will retain your Customer Data for 30 days after termination, during which you may export it. After 30 days, we will delete your Customer Data in accordance with our data retention policies.
Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will survive.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
Notwithstanding the foregoing, Atlas Digital Co. reserves the right to seek injunctive or other equitable relief in any jurisdiction to protect its intellectual property rights.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
11. Changes to Terms
We may modify these Terms at any time. When we make material changes, we will notify you by:
- Sending an email to the address associated with your account
- Displaying a prominent notice within the Service
- Updating the “Effective date” at the top of this page
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.
For material changes that significantly reduce your rights or increase your obligations, we will provide at least 30 days' advance notice before the changes take effect.
